Definitions

“You” or “Your” refers to any person who contributes money through the Red Curve

Solutions, LLC widget APEXSM.

“The Committee” refers to the owner of the website: Empower America Project

“We” or “Us” or “Our” refers to the owner and operator of the widget APEXSM, Red

Curve Solutions, LLC or its DBA Bulldog Compliance

“Site” or “Website” refers to any part of (empower.org)

“Person” refers to any individual, political committee, business entity, or any other

organization or association of individuals

General

The following terms and conditions apply to all persons who voluntarily visit this website including persons who freely contribute to the committee through the Red Curve Solutions, LLC widget APEXSM and/or voluntarily provide any information pursuant to applicable federal, state, or local law. If you do not agree to be bound by these terms and conditions, you may not use our services for any purposes. In order to proceed with any transaction on this site, you must read and accept all of the terms and conditions enumerated in this Terms of Service and the Privacy Policy. Information Gathered and How it is Used

APEXSM only collects personal information that you provide through your voluntary use of APEXSM. You certify that all information you provide is true and accurate. You agree that your use of this website and of APEXSM will not violate any applicable federal, state, or local law or regulation. The information you provide may include the following:

All credit card information ((k) credit card number, CVC, and expiration date) is immediately processed through a secure third party credit card processor who collects the funds. Once processed, the credit card information is not retained by Red Curve Solutions, LLC or the website in which APEXSM is being used.

Some information, Items (a) through (s), may be publicly reported pursuant to local, state, or federal law.

With the exception of Item (k), Information in Items (a) through (s) are archived and used for internal purposes in a secure, firewalled, and backed-up database. This information belongs to the Committee for whom Red Curve Solutions LLC provides comprehensive budgeting, treasury, and compliance services. This information may be shared or sold to like-minded committees or organizations at fair market value by the Committee. This information may also be shared with authorized third parties required to deliver a particular service. These authorized third parties may not use your information for any other purpose than to carry out the services they are performing for the Committee and/or Red Curve Solutions, LLC.

All contributions are considered final unless a legal or compliance reason requires a refund. Please contact us for further details.

Security

APEXSM is a secure software widget that employs an array of technological best practices to ensure that information is secure and protected. Your use of this website and widget is voluntary and at your own risk. Unless a state’s law prohibits otherwise, we do not make any warranties and cannot guarantee that a third-party won’t unlawfully circumvent our security measures.

Warranty

Unless otherwise limited by law, Red Curve and its ownership, employees, and agents provide its software and systems “AS IS” and without any warranty or condition, express, implied, or statutory. Red Curve does not guarantee uninterrupted service. At times, services may be interrupted due to necessary periodic updates. In addition, at times, service may be interrupted due to factors and conditions beyond our control including, but not limited to, acts of God, extreme weather conditions, power outages, or civil or political unrest.

Intellectual Property—Ownership and Registration of Trademarks and Copyrights

The marks: “RED CURVE SOLUTIONS ®,” “R RED CURVE SOLUTIONS ® (Logo),” and the slogan “I CHOOSE RED TO STAY IN THE BLACK ®” are Federally Registered service marks of Red Curve Solutions, LLC, on the Principal Register of the United States Patent and Trademark Office. The marks “APEX℠,” and “VORTEX℠” are service marks of Red Curve Solutions, LLC.

The content, images, and expression of the Red Curve Solutions website and its software programs are copyrights of Red Curve Solutions, LLC, and cannot be copied, modified, sold, transferred, or reproduced in any manner without the prior written consent of Red Curve Solutions, LLC.
